Terms and Conditions

1. Introduction Welcome to Lawngevity, a subsidiary of EnergyWorks Consulting (Pty) Ltd. By using our services, you agree to abide by these Terms and Conditions. Please read them carefully before engaging with our company.

2. Definitions

  • "Company" refers to Lawngevity, a subsidiary of EnergyWorks Consulting (Pty) Ltd.

  • "EnergyWorks" refers to EnergyWorks Consulting (Pty) Ltd, the main shareholder of Lawngevity.

  • "Client" refers to any person, business, or entity engaging with Lawngevity’s services.

  • "Services" include artificial lawn cleaning, maintenance, installation, and related services.

  • "Agreement" refers to these Terms and Conditions.

 

3. Services Provided Lawngevity specialises in:

  • Artificial lawn cleaning and maintenance.

  • Artificial lawn installation and renewal.

  • Landscaping and related services.

  • Annual maintenance contracts.

The scope of work is determined by individual service agreements between the Client and Lawngevity.

 

4. Pricing and Payment Terms

  • All service quotations are valid for 20 days unless otherwise specified.

  • Prices exclude VAT unless stated otherwise.

  • A deposit may be required before commencement of services.

  • Full payment must be made within the agreed timeframe as per invoice terms.

  • Late payments will incur interest at a rate of [insert applicable percentage] per month.

 

5. Cancellation and Rescheduling

  • Clients must provide at least 48 hours' notice for service cancellations or rescheduling.

  • Cancellations within 48 hours of the scheduled service may be subject to a cancellation fee of up to 50% of the quoted amount.

  • Lawngevity reserves the right to reschedule services due to weather conditions or unforeseen circumstances.

 

6. Warranty and Liability

  • Lawngevity provides warranties for all products and workmanship as follows:

    • Artificial Turf Products:

      • 20mm Deco – 2 Years

      • 25mm Zurich – 3 Years

      • 30mm Autumn/Spring – 5 Years

      • 35mm Summer Fun – 5 Years

      • Multisport – 5 Years

    • Workmanship Guarantee: 36 months, provided maintenance guidelines are followed.

  • Warranties are transferred to Lawngevity clients per the supplier’s and subcontractor’s service level agreement (Kwik Turf).

  • Lawngevity is not liable for pre-existing damage, improper installations not performed by our team, or issues arising from third-party work.

  • Clients must follow maintenance recommendations provided by Lawngevity to ensure the longevity of artificial turf.

  • Exclusions: Damages caused by external influences (e.g., wild animals, sharp objects, weather conditions), misuse, lack of maintenance, tree roots, reflections from shiny surfaces, or improper turf use are not covered.

 

7. Non-Circumvention Clients agree not to engage directly with Lawngevity’s subcontractors or service providers for similar services within 12 months of receiving services from Lawngevity.

 

8. Limitation of Liability

  • Lawngevity shall not be liable for indirect, consequential, or incidental damages arising from the use of its services.

  • Maximum liability in any claim shall not exceed the total amount paid for services rendered.

 

9. Health and Safety Compliance

  • Lawngevity adheres to strict health and safety guidelines during service execution.

  • Clients must ensure safe access to the service area.

 

10. Intellectual Property All marketing materials, branding, and service methodologies remain the exclusive property of Lawngevity. Unauthorized use or reproduction is prohibited.

 

11. Privacy and Data Protection

  • Lawngevity respects client confidentiality and data protection laws.

  • Client information will not be shared with third parties without consent, except as required by law.

 

12. Governing Law and Jurisdiction These Terms and Conditions shall be governed by the laws of South Africa. Any disputes shall be resolved in the courts of [insert applicable jurisdiction].

 

13. Amendments Lawngevity reserves the right to update these Terms and Conditions at any time. Clients will be notified of significant changes.
